NewSport Media may change these terms at any time and your use is subject to the changes. If you do not accept these terms, do not use this web site. Use or reproduction of the content or materials for any purpose not expressly permitted is prohibited. NewSport Media reserves the right, in its sole discretion, to terminate your access to all or part of this site, with or without notice.

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER BASIS, EVEN IF NEWSPORT MEDIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. Applicable Laws

All content and materials of this web site are protected by copyrights, trademarks or other proprietary rights and laws. These Terms and Conditions shall be governed by and construed in accordance with the laws of Ontario, excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms and Conditions or your use of this site shall be filed only in the provincial or federal courts located in Ontario, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. NewSport Media makes no representation that materials on this site are appropriate or available for use in locations outside Canada, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from outside Canada do so on their own initiative and are responsible for compliance with applicable local laws.

Termination

NewSport Media reserves the right to suspend or terminate your Account and your access to the Site, Services and Content, including Pay Services, at any time for convenience, or for any other reason, including without limitation, if: (a) the Account Credit Card is invalid for any reason; (b) you give NewSport Media and/or its affiliates or licensors false or misleading information; (c) NewSport Media and/or its affiliates or licensors does not receive any payment when due; or (d) NewSport Media has determined, in its sole discretion, that the use of a NewSport Media Site or of any Services through your Account is, or was in breach of these Terms and Conditions or you are using the Services for unlawful or improper use. Any such termination by NewSport Media will be in addition to and without prejudice to such rights and remedies as may be available to NewSport Media, including injunction and other equitable remedies. Your ability to use the Pay Services is also subject to any limits established by NewSport Media or by your Account Credit Card issuer. If Fees cannot be charged to your Account Credit Card or your charge is returned for any reason, including chargeback, NewSport Media reserves the right to either suspend or terminate your Pay Services Account and your access to the Pay Services. The disclaimer, limitations on liability, and indemnity provisions herein will survive termination or expiry of your Account, these Terms and Conditions and your Pay Services Agreement.
